 User Agreement
Being allowed access to www.fmsfindia.org ("hereinafter referred to as "web site") of FMSF (hereinafter referred to as "FMSF"), you enter into the www.fmsfindia.org user agreement on the terms and conditions set out below.
Please read this Agreement carefully before accessing or using the web site. By accessing or using the web site, you agree to be bound by the terms and conditions set forth below. If you do not wish to be bound by these terms and conditions, please do not access the website.
You understand and accept that FMSF maintains the website http:// www.fmsfindia.org to provide visitors with information about FMSF, publications, its services and products and to facilitate communication with FMSF and availing its services. You also accept that visitors to the Site are required to read the below terms, and use of the Site constitutes your acceptance and agreement to be bound by such terms.
Changes
We reserve the right to add or change/modify the site, site content terms of this Agreement at any point of time. Any changes will be posted and it is your responsibility as a user to refer to the terms on accessing this service. You agree to review the Agreement periodically to be aware of such modifications.
Limited Permission to Copy
You are permitted to print or download only selective extracts from these pages for your personal non-commercial use only. Any copies of these pages saved to disk or to any other storage medium may only be used for subsequent viewing purpose or to print extracts for personal use. You may not (whether directly or through the use of any software program) create a database in electronic or structured manual form by regularly or systematically downloading and storing all or any part of the pages from this site. Termination
You understand and agree that FMSF may, at its sole discretion and at any time, terminate your password, user account or use of any service for any reason. FMSF may also, at its sole discretion and at any time, discontinue any site or service or limit or restrict any user access thereto, for any reason. You understand and agree that FMSF may take any or more of these actions, in its sole discretion, immediately deactivate and / or delete any or all information about and concerning your user account, including your registration information. You understand and agree that FMSF shall not have any liability to you or any other person for any termination of your access to any service and / or the removal of information concerning your account.
Registration and Acceptance of Terms
In consideration of your use of service of the site, you agree to (i) comply with the rules (ii) provide accurate, complete and true information about yourself as may be required on any registration form for the service or in order to cerate your User Account and maintain and update, as applicable, your registration information with current and complete information.
Users who violate these rules, or provide inaccurate, false or non current registration information may, at FMSF's sole discretion, have their user account suspended or terminated and may be permanently banned from having any current or future service from the site.
As part of your user account, you will be responsible for creating and maintaining confidentiality of your user name and password. You are advised to select a user name other than your real name or real name of any other person. We also urge you to memorize your password or keep it in a secure place. You agree that you will (i) immediately notify FMSF of any unauthorized use of your account, and (ii) ensure that you properly exit all services at the completion of your use session. FMSF will have no liability for any loss or damage arising from your use of a user account, the site or any service or your failure to comply with these requirements.
Agreement -Use of FMSF shopping' Platform / Fee Payment
The Terms and Conditions (T&C.S) contained herein along with the Privacy Policy and Terms of Use, form an Agreement regulating our relationship with regard to the use of FMSF shopping' Platform / Fee Payment by you. Please read this Agreement carefully.
FMSF reserves the right to accept or reject your order. Products/services and information displayed on FMSF web site constitute an “order". Your order for purchase or avail services shall be subject to the terms and conditions as listed below. The agreement between you and FMSF shall be subject to the following terms and conditions:-
1. The User certifies that he/she is at least 18 (eighteen) years of age or has the consent of a parent or legal guardian.
2. By using the Shopping services of FMSF you agree to be bound by the Terms and Conditions.
3. All prices, unless indicated otherwise are in Indian Rupees.
4. All prices and availability of products are subject to change without prior notice at the sole discretion of FMSF.
5. FMSF reserves the right to refuse or cancel any order placed for a product that is listed at an incorrect price. This shall be regardless of whether the order has been confirmed and/or payment levied. In the event the payment has been processed, same shall be credited to you and you shall be duly notified by email.
6. In a credit card transaction, you must use your own credit card. FMSF will not be liable for any credit card fraud. The liability to use a card fraudulently will be on the user and the onus to 'prove otherwise' shall be exclusively on the user.
7. On receipt of your purchase or service order, FMSF shall promptly fulfill the order/ service (depending on the Product or Offer Price). Any request for cancellations of orders once duly placed on the site, shall not be entertained.
8. In the event that a non-delivery occurs on account of a mistake by you (i.e. wrong name or address) any extra cost incurred by FMSF for redelivery shall be claimed from the User placing the order.
9. FMSF shall not be liable for any delay / non-delivery of purchased goods by the Courier/ Regular Post, flood, fire, wars, acts of God or any cause that is beyond the control of FMSF.
10. The User expressly agrees that the use of service(s) FMSF Shopping/ Fee Payment is at the User's sole risk. The Service(s) of FMSF Shopping is provided on an "as is" basis without warranties of any kind, whether express or implied.
11. Presently, the service(s) of FMSF Shopping are being offered free. However, FMSF reserves the right to charge a fee for any or such facilities.
12. The User agrees to use the services provided by FMSF, its consultants and contracted organizations for lawful purposes only.
13. The User agrees to provide authentic and true information. FMSF reserves the right to confirm and validate the information and other details provided by the User at any point of time. If upon confirmation such User details are found not to be true (wholly or partly), FMSF has the right in its sole discretion to reject the registration and debar the User from using the Services of FMSF Shopping, and / or other affiliated websites without prior intimation whatsoever.
14. FMSF will not be responsible for any damage suffered by users from use of the services on this site. This without limitation includes loss of revenue/data resulting from delays, non-deliveries, missed deliveries, or service interruptions.
15. The user expressly agrees that the use of Services(s) www.fmsfindia.org website is at the user's sole risk. The Services(s) of FMSF website is provided on an "As is" Basis without warranties of any kind, whether express or implied. FMSF eployees, agents, consultants, contracted companies make no warranties of any kind, whether express or implied, for the service it is providing or as to the results that may be obtained from use of the service, or as to the accuracy, reliability or content of any information, service, or merchandise provided through this service. FMSF does not represent or warrant to maintain the confidentiality of information, although FMSF current practice is to utilise reasonable efforts to maintain such
confidentiality.
16. This agreement shall be construed in accordance with the applicable laws of India. The Courts at Delhi shall have exclusive jurisdiction in any disputes arising out or pertaining hereto.
